Learner driver terms and conditions

Please read these before booking your lessons.

These terms explain the basis on which driving tuition is provided through instructors associated with A2B Driving School.

1. About A2B and your instructor

A2B Driving School ("A2B") works with individual driving instructors who operate on a self-employed basis.

Unless expressly stated otherwise, your contract for driving tuition is between you and the individual instructor providing your lessons. Your instructor is responsible for the provision and delivery of your driving tuition.

A2B may introduce or allocate pupils to instructors and may provide instructors with administrative, marketing and other business support. This does not create an employment relationship between A2B and the instructor.

2. Instructor registration and licensing

Each instructor is responsible for ensuring that they are legally entitled to provide paid driving instruction and for maintaining all licences, registrations, insurance and other authorisations required by law.

Approved Driving Instructors must maintain their registration with the Driver and Vehicle Standards Agency (DVSA).

Trainee driving instructors must hold a valid trainee driving instructor licence and comply with all conditions applying to that licence.

An instructor must immediately cease providing paid driving instruction if they cease to be legally entitled to do so.

A2B may suspend or cease referring pupils to an instructor where A2B becomes aware of any issue concerning the instructor's entitlement to provide paid driving instruction.

3. Your eligibility to drive

To undertake driving lessons you must meet the legal minimum age requirement, hold a driving licence valid for the category of vehicle being driven in Great Britain, and satisfy any eyesight and other legal requirements applicable to learner drivers.

You must provide your instructor with evidence of your driving licence when requested.

If you cannot demonstrate that you are legally entitled to drive, your instructor may refuse to conduct the lesson and the normal cancellation charge may apply.

You must immediately inform your instructor of anything that affects your entitlement or ability to drive.

4. Paying for lessons

Unless specifically agreed otherwise, payment for lessons is made directly to your instructor.

Your instructor will advise you which payment methods they accept.

Payments made directly to an instructor are received and held by that instructor and not by A2B.

Where lessons are prepaid, the instructor is responsible for safeguarding and accounting for those funds and for providing any refund that becomes due under these terms.

You should retain evidence of payments made.

5. Lesson prices

The current lesson price will be communicated to you before tuition begins.

Lesson prices may change from time to time. Reasonable notice will normally be provided before a price increase applies.

Any lessons already paid for will be honoured at the price applicable when they were purchased, subject to these terms.

6. Organising lessons

You and your instructor are responsible for agreeing the date, time, duration and meeting location for individual lessons.

Lesson availability cannot be guaranteed.

Your instructor may change their availability because of holidays, illness, vehicle problems, driving tests or other reasonable circumstances.

7. Cancellations

You must provide your instructor with at least 48 hours' notice if you wish to cancel or rearrange a lesson.

Where less than 48 hours' notice is given, your instructor may charge the full lesson fee.

Your instructor may cancel or rearrange a lesson at shorter notice because of illness, vehicle breakdown, adverse weather, safety concerns or another reasonable unforeseen circumstance.

Where your instructor cancels a prepaid lesson, you will not lose the lesson fee and the lesson will be rearranged or the appropriate credit retained.

8. Prepaid lessons and refunds

Money paid in advance is held by your individual instructor.

If you decide to stop taking lessons, you may request a refund from your instructor for any unused prepaid lessons, subject to any legitimate outstanding lesson or cancellation charges.

Refunds will normally be made using the original payment method where reasonably possible.

Prepaid lessons should normally be used within six months of purchase unless otherwise agreed with your instructor.

Nothing in these terms affects any statutory rights you may have.

9. Driving tests

Responsibility for booking and managing your practical driving test rests with you.

Booking a driving test does not guarantee that your instructor will consider you ready to take the test or that their vehicle will be available.

You should discuss potential test dates with your instructor before making arrangements involving their vehicle.

Your instructor will regularly assess your progress and advise you whether, in their professional judgement, you have reached an appropriate standard to take the test.

10. Use of the instructor's vehicle for a driving test

Use of an instructor's vehicle for a practical driving test is at the instructor's discretion.

An instructor may refuse use of their vehicle where they reasonably believe you have not reached a safe test standard; your driving could present an unacceptable risk; you have not demonstrated sufficient independent driving ability; required lessons or assessments have not been completed; the vehicle cannot legally or safely be used; or another reasonable safety or insurance issue exists.

Where reasonably possible, the instructor will give sufficient notice to allow you to consider your options concerning your test.

11. Short-notice driving tests

A short-notice test is a practical driving test where there are two weeks or less between your first planned lesson with the instructor and the test date.

Acceptance of a pupil with a short-notice test is entirely at the instructor's discretion.

The instructor may require an initial assessment before agreeing to provide their vehicle for the test.

If the instructor considers that you have not reached the required standard, they may decline to provide their vehicle for the test.

Any remaining prepaid lesson credit can continue to be used for further tuition or refunded where applicable under these terms.

12. Fitness to drive

You must be fit to drive safely for every lesson.

You must tell your instructor about anything that may materially affect your ability to drive safely.

Your instructor may terminate or refuse a lesson where they reasonably believe you are unfit to drive safely, including because of alcohol, drugs, medication, illness, tiredness or another condition affecting safe driving.

Where the circumstances were reasonably within your control, the instructor may charge for the lesson.

13. Conduct and safety

Both pupils and instructors are expected to behave respectfully.

Your instructor may terminate a lesson where your behaviour is abusive, threatening, discriminatory, dangerous or otherwise unacceptable.

Your instructor may take control of the vehicle or end a lesson whenever reasonably necessary for safety.

14. Instructor vehicles

The instructor is responsible for ensuring that any vehicle they provide for paid driving instruction is appropriately insured, roadworthy and legally suitable for that purpose.

Vehicle availability cannot be guaranteed. In the event of breakdown, accident or another vehicle-related issue, the instructor may rearrange the lesson or make alternative arrangements.

15. Transferring lessons

Prepaid lessons purchased in your name cannot normally be sold or transferred to another person without your instructor's agreement.

16. Gift vouchers

Gift vouchers may only be used by a person legally entitled to undertake driving lessons; must be redeemed before the expiry date shown; cannot be exchanged for cash; and are subject to any additional conditions stated on the voucher.

Your statutory rights are unaffected.

17. Introductory offers

Introductory offers are available only where specifically advertised and subject to the conditions of the particular offer.

Unless stated otherwise, introductory offers are available to new A2B customers only and are limited to one offer per customer.

A2B may amend or withdraw promotional offers at any time before purchase.

18. Complaints

If you have a concern regarding your lessons, you should initially raise it with your instructor so they have an opportunity to resolve the matter.

If the issue cannot be resolved, you may contact A2B and we will endeavour to assist in resolving the complaint.

Where appropriate, concerns regarding an instructor's professional conduct may also be raised with the DVSA.

19. Personal information

Personal information provided to A2B and/or your instructor may be used where reasonably necessary to administer enquiries and lesson arrangements; communicate with you; maintain appropriate business and training records; deal with payments, disputes and complaints; prevent or investigate fraud; and comply with legal or regulatory obligations.

Personal information will be handled in accordance with applicable UK data protection law and A2B's Privacy Policy.

20. Limitation of A2B's role

Individual instructors are responsible for the driving tuition they personally provide.

Where an instructor operates on a self-employed basis, A2B's role may include introducing pupils, advertising, administration and providing other business support.

Nothing in these terms excludes or restricts any liability which cannot legally be excluded or restricted, nor does anything in these terms affect your statutory consumer rights.

21. Changes to these terms

These terms may be updated from time to time to reflect changes to A2B's services, DVSA requirements or applicable law.

The terms applicable to your tuition will be made available on the A2B website.
